The Claim Shield Bot name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Claim Shield Bot or its affiliates or licensors. The proprietary methodology "The Scope Check" is intellectual property of Claim Shield Bot. You may not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on the Service are the trademarks of their respective owners.
You are granted a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal, non-commercial use. This license does not include any right to resell or commercial use of the Service or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of the Service or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools.
6. User Content and Submissions
The Service may allow you to submit, upload, publish, or otherwise make available content, including but not limited to photos of property damage, descriptions of insurance claims, contractor proposals, and other information related to your use of the Service ("User Content"). You retain all ownership rights in your User Content, but you grant Claim Shield Bot a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the Service and our business operations.
You represent and warrant that you own or control all rights in and to your User Content and have the right to grant the license granted above to us and our affiliates and service providers. You further represent and warrant that all of your User Content does and will comply with these Terms and will not violate any law or infringe any rights of any third party.
We reserve the right, but are not obligated, to monitor, review, or remove User Content at our sole discretion, including User Content that we believe violates these Terms, is harmful or objectionable, or for any other reason. We do not endorse any User Content or any opinion, recommendation, or advice expressed therein, and we expressly disclaim any and all liability in connection with User Content.

Claim Shield Bot does not warrant that the Service will be uninterrupted, timely, secure, or error-free; that the results that may be obtained from the use of the Service will be accurate or reliable; or that the quality of any products, services, information, or other material obtained through the Service will meet your expectations. While we strive to connect users with trustworthy local contractors through our Service, Claim Shield Bot does not guarantee the quality, safety, or legality of contractors listed on claimshieldbot.com. We do not endorse any specific contractor and are not responsible for the actions, work quality, or business practices of any contractor you may engage through our Service. You are solely responsible for conducting your own due diligence before hiring any contractor.

8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CLAIM SHIELD BOT, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.
This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if Claim Shield Bot has been advised of the possibility of such damage. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
In no event shall the total liability of Claim Shield Bot to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing the Service during the twelve (12) months prior to the event giving rise to the liability, or one hundred dollars ($100), whichever is greater.
9. Indemnification
You agree to defend, indemnify, and hold harmless Claim Shield Bot, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.
This indemnification obligation includes, but is not limited to, claims arising from your User Content, your use of information obtained from the Service, your engagement with contractors found through claimshieldbot.com, and any breach of your representations and warranties set forth in these Terms. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.
10. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us at the email address provided below.
All provisions of these Terms which by their nature should survive termination shall survive termination, including without limitation ownership provisions, warranty disclaimers, indemnity, and limitations of liability. Termination of your access to and use of the Service shall not relieve you of any obligations arising or accruing prior to such termination.
11. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which Claim Shield Bot is headquartered, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located within that state for the purpose of litigating all such claims or disputes.
Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in English, and the arbitral decision may be enforced in any court. Notwithstanding the foregoing, Claim Shield Bot may seek injunctive or other equitable relief to protect its intellectual property rights in any court of competent jurisdiction.
12. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect through a notice on claimshieldbot.com or via email to the address associated with your account. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service. It is your responsibility to review these Terms periodically for changes.
13. Miscellaneous
These Terms constitute the entire agreement between you and Claim Shield Bot regarding the use of the Service and supersede all prior and contemporaneous written or oral agreements between you and Claim Shield Bot. No waiver by Claim Shield Bot of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition.
If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect. The failure of Claim Shield Bot to enforce any right or provision of these Terms will not be considered a waiver of those rights.
